Side Guards Top of Mind for Underride Committee

The upcoming session of the National Highway Traffic Safety Administration’s Advisory Committee on Underride Protection will turn its attention to side underride crashes, marking a crucial step in addressing this specific type of collision. Scheduled for a virtual meeting on Wednesday, March 13, from 12:30 to 4:30 p.m. eastern, this will be the committee’s fourth gathering since its inception in May 2023, and notably, the first one dedicated exclusively to exploring side underride guards.

Underscoring the significance of this meeting is the fact that NHTSA is contemplating the possibility of mandating side underride guards on tractor-trailers, with the committee’s insights playing a pivotal role in shaping the agency’s decisions. While current regulations outline requirements for rear impact guards on trailers, there are currently no federal stipulations regarding side underride guards.

Underride crashes typically occur when a vehicle slides beneath a tractor-trailer. Advocacy for a side underride guard mandate has been long-standing among safety groups. However, truckers have raised concerns about unintended consequences and practicality issues related to maintenance.

In April of the previous year, NHTSA initiated an advance notice of proposed rulemaking, laying the groundwork for potential regulations that aims to “assess the feasibility, benefits, costs and other impacts of installing side underride guards on trailers and semitrailers.”

The advisory committee comprises individuals, including Jennifer Tierney, Marianne Karth, and Jane Mathis, who tragically lost loved ones in underride-related accidents. Jennifer Tierney, representing the Truck Safety Coalition, has urged the committee to take decisive action.

“I just want you all to understand that if you could guarantee that this never happened to you, you would, but you can’t,” Tierney said. “So, anybody on this committee today could be sitting here with the same broken heart that Jane has, that Marianne has, and that I have. And I just ask that you all remember that and think about that. If we sit on this committee for all these months, if we do nothing to stop these horrific crashes, and then God forbid, something happens to someone you love, would you ever forgive yourself?”

Committee member Jeff Bennett, representing the Utility Trailer Manufacturing Company, cautioned against trading one type of fatality crash for another, emphasizing the need for careful consideration.

“I agree that we should be doing all that we can do to reduce fatalities on the road – no question,” Bennett said. “My heart goes out to those of you who have lost loved ones. I can’t imagine a greater hell on earth. But at the same time, these side underride guards do change the system, and they change the system in ways that we are not fully aware … We do not want to trade off side underride deaths for another type of death.”

Doug Smith, the sole trucker on the committee and an OOIDA board member, highlighted the challenges faced during the committee’s meetings.

“We’re like 19 members and you can say that three of us are pro-industry,” Smith said. “We spend a lot of our time talking about unintended consequences … I feel like we’re really in an uphill battle because there are members of this committee who have in their mind what they want, and they’re not going to stop until they get it.”

NHTSA estimates that a side underride mandate on all trailers and semitrailers could save 17.2 lives annually, bringing about safety benefits of up to $166 million. However, the annual cost of implementing the mandate is projected to be as high as $1.2 billion.

As of the U.S. Department of Transportation’s Fall 2023 Unified Regulatory Agenda, the rulemaking process is currently in the “analyzing comments” stage, with no anticipated action until October. NHTSA is expected to await the committee’s recommendations before deciding on the next course of action.
